Nokulunga Gumede (59), a former Branch Commander of the South African Police Service, briefly appeared in the Pinetown Magistrate Court on Wednesday, March 13, 2024, facing charges of obstructing the course of justice and unauthorized removal of an inmate from a correctional service center.
Gumede, who held the rank of Captain at the KwaMakhutha police station, stands accused of an incident dating back to April 17, 2020. It is alleged that on that day, she visited Westville prison and facilitated the release of her biological son, who was detained for assault with intent to cause grievous bodily harm. This action, purportedly done without the knowledge of the investigating officer and lacking proper court documentation, has led to her current legal troubles.
Following the release of her son, Gumede attempted to take him to court, only to find that the matter couldn’t proceed due to COVID-19 restrictions. Undeterred, she then took him home. Subsequently, a case of obstructing the course of justice and unauthorized removal of an inmate from a correctional service center was reported, prompting an investigation by Hawks members from Durban’s Serious Corruption Investigation unit.
After being summoned to appear in court on February 5, 2024, Gumede was released on a warning pending further legal proceedings. The case has been postponed to March 27, 2024, for continuation.
In a separate incident, Constable Sherwin Chetty (28) faced the Verulam Magistrate Court on charges of dealing in drugs and unlawful possession of ammunition. Chetty, a serving police officer, was apprehended by Hawks members during a roadblock operation following information received about his alleged involvement in drug transportation.
Chetty was remanded in custody pending a formal bail application. His case has been postponed to March 20, 2024, as investigations continue.
